TOWN OF GRANBY
The Board of Selectmen of the Town of Granby, pursuant to the Bylaws of the Town of Granby, Chapter 9, Section 2, and the Granby Planning Board Pursuant to the provisions of M.G.L. Chapter 40A, Section 5, will hold a Public Hearing to present and discuss proposed amendments to the Town of Granby General Bylaws and the Granby Zoning Bylaws. The subject matter of the proposed amendments is as follows:

The subject matter of the proposed General Bylaw amendments is in regard to:
To delete from the bylaws of the Town of Granby Volume 1, Chapter XVII, Section 7-Temporary Marijuana Establishment Moratorium and insert:
Chapter XVII-Section 7 Marijuana Establishment Ban- Consistent with MGL Ch. 94G, Section 3(a)(2), all types of marijuana establishments as defined in MGL Ch. 94G, Section 1(j), to include all marijuana cultivators, marijuana testing facilities, marijuana product manufacturers, marijuana retailers or any other types of licensed marijuana-related businesses, shall be prohibited within the Town of Granby. This Section does not apply to the personal use of marijuana or growing of marijuana at a residence as permitted by law, nor to Medical Marijuana Treatment Centers as defined in Section 5.9 of the Zoning Bylaws.
The subject matter of the proposed Zoning Bylaw amendments is in regard to:
Amending Section V-Special use Regulations and Performance Standards by adding the following under section:
5.12 Cannabis Retail/Growing and Distribution
Cannabis retail/commercial will only be allowed in General Business (GB)
No closer than 500 ft. property pin to property pin straight line to a public or private school to include any licensed daycare
This is subject to special permit and site plan approval by the Planning Board
Commercial growth/operation shall be indoor facilities only and allowed only in Industrial (I) and Business Park Overlay District with site plan approval
Amending Section III - Use Regulations - Subsection 3.0 Schedule of Use Regulations - TABLE 1 SCHEDULE OF USE REGULATIONS by adding a new Land Use Classification-Retail and Services “Cannabis Retail Operation” – allowed by-Special Permit with Site Plan Approval by the Planning Board in General Business only.
Amending Section III - Use Regulations - Subsection 3.0 Schedule of Use Regulations - TABLE 1 SCHEDULE OF USE REGULATIONS by adding a new Land Use Classification- Wholesale, Industrial Transportation-“Commercial Growth Operation” – allowed by-Special Permit with Site Plan Approval by the Planning Board in the Industrial District and Industrial District-2 only.
